1. the owner of the website operated at www.vertigojazz.pl (hereinafter referred to as the “VERTIGOJAZ SERVICE”) is Save The World Real Estates Sp. z o.o. with its registered office in Wrocław at ul. Łaciarska 4, 50-104 Wrocław, entered in the Register of Entrepreneurs of the National Court Register under KRS no.: 0000421288, whose registration files are kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Economic Department of the National Court Register, NIP: 899-273-57-94 and REGON: 021884758, with share capital: PLN 20,000,000.00 (hereinafter referred to as STWRE or the Company or the Data Controller.
2. STWRE attaches particular importance to respecting the privacy of users of the VERTIGOJAZZ SERVICE. Therefore, we present a document defining the rules and the manner of collecting, processing and using information about the users of the VERTIGOJAZ SERWISE.
3. The legal basis for the introduction of this Privacy Policy is the REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as RODO).
I. Preliminary information.
1. STWRE has the appropriate permissions to use the data presented on the VERTIGOJAZZ SERIES. The use of data from pages posted on the VERTIGOJAZZ SERVICE for commercial purposes requires each time written consent of STWRE.
2. STWRE fully respects the right to privacy and protection of personal data of VERTIGOJAZZ SERVICE Users.
3. STWRE makes every effort to protect the VERTIGOJAZZ SERVICE from unauthorized access of third parties. This includes the use of firewalls, server security devices, encryption devices and physical security measures. Notwithstanding the above, STWRE makes every effort to ensure that personal data is always:
1) correct and processed in a lawful manner,
2) obtained only for specific purposes and not further processed in a manner incompatible with those purposes,
3) kept no longer than necessary,
4) processed in accordance with the rights of the data subjects, including the right to reserve access,
5) not transferred without adequate protection.

II. Processing of Users’ personal data.
1. The data of the Users of the VERTIGOJAZZ SERVICE are processed by STWRE, depending on the basis of their processing, for various purposes. In particular, STWRE processes the data of VERTIGOJAZZ SERWIS users:

1) In order for STWRE to perform the legal obligations incumbent upon it, here resulting from regulations obliging STWRE to maintain accounting and tax records and settlements of tax and public law receivables, from regulations concerning complaint proceedings in favor of Users, or to ensure that the Users of the VERTIGOJAZZ SERVICE are able to use the VERTIGOJAZ SERVICE safely and lawfully – for a period of time each time resulting from a specific legal regulation – such as. mandatory time of storing documentation for tax purposes, mandatory time of storing documentation related to the provision of electronic services.

2) In order to conclude and perform an agreement entered into by STWRE with the User of the VERTIGOJAZ SERVICE, including for example. contract for the provision of services consisting in the delivery of specific goods or content to the User, such as press materials, newsletters, a contract enabling VERTIGOJAZZ SERWIS users to use the VERTIGOJAZZ SERWIS and its functionality, or in the performance of obligations arising from the course of Contests organized on the pages of the VERTIGOJAZZ SERWIS – for the duration of the contract, and after that time only if justified by another purpose and legal basis for data processing, such as the need to assert claims under the contract or keep financial and accounting records;

3) In order to monitor the correctness and security of the operation of the VERTIGOJAZZ SERVICE, as well as to provide its Users with technical and service support, including information about the scope of services provided to the User, failures and security risks – for the duration of the User’s use of the VERTIGOJAZZ SERVICE, and after that time only if justified by another purpose and legal basis for data processing, e.g. the need to keep records on monitoring compliance with the law on the network;

4) In order to prevent abuse and violation of the law in the use of the VERTIGOJAZZ SERVICE- for the duration of the User’s use of the VERTIGOJAZZ SERVICE, and thereafter only if justified by another purpose and legal basis for data processing, such as the need to keep records of online compliance monitoring;

5) For the purpose of establishing the defense and assertion of claims to which STWRE is entitled – for the time necessary to establish and assert these claims, as well as to enforce them, in particular resulting from the statute of limitations, and after that time only if justified by another purpose and legal basis for data processing, such as the need to maintain financial and accounting records;

6) For the purpose of direct marketing of our own products, as well as those carried out on someone else’s behalf, for the duration of the contract or use of the VERTIGOJAZZ SERVICE, and on the basis of a separate consent – to the extent and for the duration for which it was granted;

7) For analytical, research and development purposes, compilation, statistics, conducting research, comparative surveys, for internal needs of STWRE, e.g. for improvement of the VERTIGOJAZZ SERVICE and services provided through it, as well as on the basis of separate Regulations for the purpose of conducting research on a specific issue, brand or product – for the duration of the contract or use of the VERTIGOJAZZ SERVICE, and on the basis of a separate consent – for the period for which it was granted, and in the case of anonymized data – for an unlimited period of time.

(2) STWRE shall process the personal data of the Users of the VERTIGOJAZZ SERVICE only when it is lawful to do so, only for the time necessary for the specific purpose of the processing and only in cases where, and to the extent that, one or more of the conditions described in paragraphs 1) – 5) below are met.

1) STWRE processes personal data of Users of the VERTIGOJAZZ SERVICE in case the data subject has given his/her consent to the processing of his/her personal data for one or more specified purposes (legal basis Art. 6 (1) (a) RODO).

In this case, consent is always voluntary. STWRE shall inform Users each time whether the expression of consent is necessary for the provision of any services to the User, or whether it is contingent on the granting of consent to achieve the specific purpose for which consent is received. The granting of consent by the User of the VERTIGOJAZZ SERVICE for the use of the User’s personal data is completely voluntary, and such consent may be withdrawn by the User at any time, but the withdrawal of consent does not affect the legality of the processing performed on the basis of consent before its withdrawal. If the consent for data processing is withdrawn, or after the expiration of the consent period, STWRE will have the right to process the personal data of the User of the VERTIGOJAZZ SERVICE only for the time and to the extent permitted by the provisions of generally applicable law, including as part of STWRE’s performance of legal obligations or STWRE’s legitimate legal interest, which is, in particular, the legally required obligation to document STWRE’s activities, or in order to assert claims or to protect STWRE from claims and other negative consequences, e.g. official penalties.
1 a) STWRE does not expect Users of the VERTIGOJAZZ SERVICE to provide STWRE with so-called sensitive data (data of a special nature, revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person or data concerning the health, sexuality or sexual orientation of that person), nor to give their consent to such processing.

However, if the User decides to provide and/or publish such data, which may be done, for example, by assigning to the User’s own account an image identifying the User, or voluntarily providing such data by the User in the course of discussions held in the forums, the User thereby consents to the processing of such data to the extent and for the purpose for which he himself posted it on the VERTIGOJAZZ SERVICE and published it (legal basis of Article 9(2)(a) RODO).STWRE does not process such data for any other purpose or in any other way.

2) STWRE processes personal data of the Users of the VERTIGOJAZZ SERVICE in case the processing is necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract (legal basis Article 6(1)(b) RODO).

In this case, STWRE processes the Data of the Users of the VERTIGOJAZZ SERVICE both in advance of the conclusion of the contract (the User’s accession to the use of the VERTIGOJAZ SERVICE): e.g. in order to develop a specific offer/information about the VERTIGOJAZZ SERVICE for the User, as well as during the term of the contract (the User’s use of the VERTIGOJAZZ SERVICE): to the extent necessary for the proper performance of the contract, including for the performance and enforcement of the obligations incumbent on the Parties, for the processing of complaints filed and for the return of benefits in the event of withdrawal from the contract (if you have such a right), and after the termination of the contract, may only process them on another legal basis, for the purpose and only for the time and to the extent permitted by generally applicable law, including in the performance of STWRE’s legal obligations or STWRE’s legitimate interest, such as, in particular, the legally required obligation to document STWRE’s activities or for the purpose of establishing and asserting claims.

3) STWRE processes personal data of Users of the VERTIGOJAZZ SERVICE in case the processing is necessary for the fulfillment of a legal obligation incumbent on STWRE (legal basis Article 6(1)(c) RODO)

In this case, the scope of such an obligation, the specific legal basis for such processing its purpose and the period of processing are indicated in each case by specific legal regulations, such as those relating to the obligation to keep records, to inform authorized departments and authorities of violations of the law.

4) STWRE processes personal data of Users of the VERTIGOJAZZ SERVICE when the processing is necessary to protect the vital interests of the data subject or another natural person (legal basis Article 6(1)(d) RODO);

In such a case, STWRE stores, for example, data, the loss of which could have negative consequences for the User of the VERTIGOJAZZ SERVICE, such as evidence of the User’s execution of payments charged to him/her (for services provided for a fee), in the event that attempts are made to use the resources of the VERTIGOJAZZ SERVICE to violate the rights and property of the User or others.

5) STWRE processes personal data of VERTIGOJAZZ SERVICE Users where the processing is necessary for purposes resulting from legitimate interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child (legal basis of Article 6(1)(f) of the DPA).

In this case, we process the data, e.g. for the purposes of direct marketing, to establish and assert our claims, to ensure the efficiency of the VERTIGOJAZZ SERVICE, for analytical and research purposes. In no case, however, do we process the data of persons under the age of 16 in this regard, unless their legal guardian or legal representative expressly consents to this processing.

3. STWRE sp. z o.o. with its registered office in Wrocław at ul. Wiśniowa 85C/10, 53-126 Wrocław, registered in the Register of Entrepreneurs of the National Court Register under the KRS number: 0000552130, whose registration files are kept by the District Court for Wrocław – Fabryczna VI Economic Division of the KRS, having NIP: 899276557, REGON: 361280936,with the share capital of 7950000,00 PLN,with regard to personal data of VERTIGOJAZZ SERVICE users is the Personal Data Administrator within the meaning of RODO. Personal data is stored and processed by STWRE, at STWRE’s place of business, or the entity processing the data on its behalf, with appropriate security measures that meet the requirements of the law.
4. Provision of personal data by Users is voluntary, while some of the data may be provided in an automated manner through the settings of the User’s devices and IT tools used to use the VERTIGOJAZZ SERVICE. STWRE shall each time inform the User of the VERTIGOJAZZ SERVICE which data are necessary for the performance of specific services or an agreement in favor of the User. STWRE does not require Users to provide data of a specific nature – see paragraph 2 para. 1a) above.
III. Rights of Users of the VERTIGOJAZZ SERVICE related to data processing
1. The VERTIGOJAZZ SERVICE shall ensure the exercise of the rights arising from the REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO), and in particular, each User of the VERTIGOJAZZ SERVICE shall have the right to control the processing of the data concerning him/her, including those contained in datasets, and in particular the right to:
a) to obtain comprehensive information on whether data is processed and to determine the Data Controller, the address of its registered office and its full name,
(b) obtain information about the purpose, scope and manner of data processing,
(c) obtain information from when data concerning it is processed, and provide in a commonly understood form the content of such data,
(d) to obtain information about the source of its data,
(e) obtain information on how the data will be shared, and in particular information on the recipients or categories of recipients to whom the data are shared,
(f) demand that personal data be supplemented, updated, rectified, temporarily or permanently suspended or erased if they are incomplete, outdated, untrue or have been collected in violation of the law, or are no longer necessary for the purpose for which they were collected
(g) to lodge a written, reasoned request to cease processing of his or her data due to his or her particular situation, if even the processing is necessary for the fulfillment of the legitimate purposes of the Data Controller, and the processing does not violate the rights and freedoms of the data subject,
(h) to object to the processing of his/her data in cases where the processing is necessary for the fulfillment of the legitimate purposes of the Data Controller and the processing does not violate the rights and freedoms of the data subject, where the Data Controller intends to process the data for marketing purposes, or to the transfer of his/her personal data to another Data Controller,
(i) to request the Data Controller to reconsider an individual case decided in violation of the prohibition of final determination of an individual case, when the content was exclusively the result of operations on personal data maintained in the computer system
(j) the right to complain to the supervisory authority.

(2) In order to exercise the above-mentioned rights, STWRE shall provide Users of the VERTIGOJAZZ SERVICE with the opportunity to exercise their right to access the data concerning it and to obtain the following information including:
(a) purposes of processing;
(b) categories of personal data involved;
(c) information about the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
(d) as far as possible, the planned period of storage of personal data, and when this is not possible, the criteria for determining this period;
(e) if the personal data was not collected from the data subject, any available information about its source;
(f) information on automated decision-making, including profiling, and relevant information on the principles of such decision-making, as well as the significance and anticipated consequences of such processing for the data subject;
(g) information on the transfer of data to a third country (outside the European Economic Area).
(3) In order to exercise the above-mentioned rights, STWRE shall provide the Users of the VERTIGOJAZZ SERVICE with the opportunity to exercise the right to request immediate rectification of personal data concerning it that is incorrect and completion of incomplete personal data, including by providing an additional statement.
(4) In order to exercise the aforementioned rights, STWRE shall provide Users of the VERTIGOJAZZ SERVICE with the opportunity to exercise their right to erasure of data (“right to be forgotten”) if one of the following circumstances occurs:
(a) personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
(b) the data subject has withdrawn the consent on which the processing is based in accordance and there is no other legal basis for the processing;
(c) the data subject objects to the processing and there are no overriding legitimate grounds for the processing;
(d) the personal data have been processed unlawfully;
(e) the personal data must be erased in order to comply with a legal obligation under generally applicable law to which the Administrator is subject;
(f) the personal data were collected in connection with the offering of information society services offered to children under 16.

unless the processing is necessary:
(a) to exercise the right to freedom of expression and information;
(b) to comply with a legal obligation requiring processing under Union law or the law of a Member State to which the Administrator is subject, or to carry out a task carried out in the public interest or in the exercise of official authority vested in the Administrator;
(c) for reasons of public interest in the field of public health;
(d) for legitimate archival purposes in the public interest, for scientific or historical research, or for statistical purposes, insofar as the right referred to in para. 1 will prevent or seriously impede the purposes of such processing; or
e) for the establishment, investigation or defense of claims.

(5) In order to exercise the above-mentioned rights, STWRE provides the Users of the VERTIGOJAZZ SERVICE with the opportunity to exercise the right to restrict processing in the following cases:
(a) the data subject questions the accuracy of the personal data – for a period of time that allows STWRE to verify the accuracy of the data;
(b) the processing is unlawful and the data subject objects to the erasure of the personal data, requesting instead a restriction on its use;
(c) STWRE no longer needs the personal data for the purposes of the processing, but they are needed by the data subject to establish, assert or defend a claim;
(d) the data subject has objected to the processing – until it is determined whether the legitimate grounds on the part of STWRE override the grounds of the data subject’s objection.

6. In order to exercise the aforementioned rights, STWRE shall provide Users of the VERTIGOJAZZ SERVICE with the opportunity to exercise the right to data portability, giving it the right to receive in a structured, commonly used machine-readable format the personal data concerning it that it has provided to STWRE, and it shall have the right to request that such personal data be sent to another Controller without hindrance from the Data Controller to whom the personal data was provided, if:
(a) the processing is based on the consent of the data subject or on the basis of a contract to which the data subject is a party; and
(b) the processing is carried out by automated means.
Provided that the exercise of rights referred to above shall not adversely affect the rights and freedoms of others.

(7) In order to exercise the aforementioned rights, the STWRE shall provide Users of the VERTIGOJAZZ SERVICE with the opportunity to exercise the right to object, such that any data subject shall have the right to object at any time – for reasons related to his or her particular situation – to the processing of personal data concerning him or her carried out for the performance of public tasks or legitimate interests of the STWRE, including profiling. The STWRE shall no longer be allowed to process such personal data unless it demonstrates the existence of compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or grounds for establishing, asserting or defending claims. إدين هازارد If personal data is processed for the purposes of direct marketing, the data subject has the right to object at any time to the processing of personal data concerning him or her for such marketing, including profiling, to the extent that the processing is related to such direct marketing. 8 In order to exercise the above-mentioned rights, STWRE informs Users of the VERTIGOJAZZ SERVICE about the right to file a complaint to the President of the Office for Personal Data Protection about the processing activities in case the processing violates the law.
(9) In order for STWRE to ensure the exercise of the aforementioned rights to not be subjected to a decision that is based solely on automated processing, including profiling, and that produces legal effects on that person or in a similar manner significantly affects that person, STWRE informs the Users of the VERTIGOJAZZ SERVICE that when using the VERTIGOJAZ SERVICE, small files (especially text files), so-called cookies, are stored on the final device (computer, tablet, smartphone, etc.). Thanks to the storage of these files, it is possible, among other things, to remember login data, so that it will not be necessary for the User to enter login and password each time, to remember the goods added by the User to the shopping cart or clipboard. Cookies do not contain data on the basis of which it is possible to establish someone’s identity. These files are in no way harmful to the device and do not change its settings or the settings of the software installed on it. They can only be sent by the browser to the server that created them. Thus, STWRE uses cookies to adapt the content of the VERTIGOJAZZ SERIES web pages to your preferences and to optimize the use of the VERTIGOJAZZ SERIES, e.g. by allowing you to remember your settings and preferences. Thanks to storing these files on your device, among other things, it will not be necessary for you to enter your login and password each time. In addition, it uses them to create anonymous, aggregated statistics that help to understand how the User uses the VERTIGOJAZZ SERWISE, which allows to improve its structure and content, excluding personal identification of the User. In addition, STWRE may place, or allow a third party to place, cookies on the User’s device in order to ensure the proper functioning of the VERTIGOJAZZ SERIES. This helps STWRE monitor and verify the operation of the VERTIGOJAZZ SERIES. These entities may include, but are not limited to, Google or PBI Gemius, which collect the necessary data for STWRE.Most of the time, your browser settings allow cookies by default. However, the user of the VERTIGOJAZZ SERVICE can set their browser in such a way that cookies are not stored on their disk, or automatically deleted at a certain time. Thus, these settings can be changed in such a way as to block the automatic handling of cookies in the settings of the browser or inform about their transmission to the user’s device each time. IV. Sharing and transfer of data.
1. STWRE informs the Users of the VERTIGOJAZZ SERVICE that, in the course of fulfilling the purpose of processing, it may transfer personal data to entities cooperating with it in fulfilling the purpose. These entities will have the right to use them to the full extent of the consent given to STWRE. Such entities may be, in particular:
a) Entities providing services to STWRE in the scope of conducting day-to-day operations, such as accounting and legal offices, entities maintaining the technical infrastructure with the use of which STWRE conducts its business, including on which the VERTIGOJAZ SERWIS
b) Subcontractors of services provided by STWRE;
c) Entities participating in Advertising Campaigns carried out by STWRE, sponsors;
d) STWRE Partners – co-organizers of specific activities
11. STWRE informs the Users of the VERTIGOJAZZ SERVICE that on the basis of applicable law, it may be obliged to release information, including in particular the IP number of the computer, contained in access logs at the request of state authorities authorized by law for the purposes of their investigations.
12 STWRE does not plan to transfer personal data of VERTIGOJAZZ SERVICE Users outside the European Economic Area.

V. Suggested security rules
To increase the security of your data, in case the functionality of the VERTIGOJAZZ SERVICE allows you to create and hold a User account, please remember to:
– establish a login and password for your account in such a way as to prevent them from being easily guessed by third parties. For this purpose, it is particularly recommended to use a sequence of characters and digits, as well as uppercase and lowercase letters;
– each time logging out of the website after the end of activity, (for example, from the VERTIGOJAZZ SERVICE website after the end of a session). In particular, logging out of the VERTIGOJAZZ SERWIS website will take place after clicking on the text “Log out”;
– keeping the login and password to the User’s account confidential, including, in particular, not passing the data (login, password) to any third party;
– using anti-virus programs, including regular scanning of disks for viruses;
– using the website only through trusted computers on which only verified and legal software is installed. Using other people’s computers raises the risk of interception of the login, password or other data provided;

VI. Change of Privacy Policy
STWRE reserves the right to change this Privacy Policy by publishing changes to the text or by publishing a new text. Changes become effective 14 days after they are made available.
